We may use your Personal Data in responding to correspondence that we receive from you, contacting you when necessary or requested, and sending you information about Backpack or the Services. We may also use your Personal Data to send emails and other communications according to your preferences or that display content that we think will interest you.

Data that is Not Personal Data
We may create aggregated, de-identified or anonymized data from the Personal Data we collect, including by removing information that makes the data personally identifiable to a particular user. We may use such aggregated, de-identified or anonymized data and share it with third parties for our lawful business purposes, including to analyze, build and improve the Services and promote our business, provided that we will not share such data in a manner that could identify you.
While we make every effort to ensure that all Personal Data we collect and store is accurate, complete, and up-to-date, you can help us by promptly notifying us if there are any changes to your information. You will be able to view and change aspects of your Personal Data by logging in to your Backpack Account.
We retain Personal Data about you for as long as necessary to provide you with our Services or to perform our business or commercial purposes for collecting your Personal Data. When establishing a retention period for specific categories of data, we consider who we collected the data from, our need for the Personal Data, why we collected the Personal Data, and the sensitivity of the Personal Data. In some cases we retain Personal Data for longer, if doing so is necessary to comply with our legal obligations, resolve disputes or collect fees owed, or is otherwise permitted or required by applicable law, rule or regulation. We may further retain information in an anonymous or aggregated form where that information would not identify you personally.
For example, we retain your device/IP data for as long as we need it to ensure that our systems are working appropriately, effectively and efficiently.
Under California Civil Code Sections 1798.83-1798.84, California residents are entitled to contact us to prevent disclosure of Personal Data to third parties for such third parties’ direct marketing purposes; in order to submit such a request, please contact us at support@backpack529.com.
If you are a resident of Nevada, you have the right to opt-out of the sale of certain Personal Data to third parties. You can exercise this right by contacting us at support@backpack529.com with the subject line “Nevada Do Not Sell Request” and providing us with your name and the email address associated with your account. Please note that we do not currently sell your Personal Data as sales are defined in Nevada Revised Statutes Chapter 603A.
We are committed to protecting the privacy and confidentiality of your Personal Data. We limit access to your Personal Data to our authorized employees or agents and we contractually require our business partners and service providers to limit their use of your Personal Data. We also maintain physical, technical, and administrative safeguards to protect your Personal Data against loss, misuse, damage or modification, and unauthorized access or disclosure. Although we work to protect the security of your account and other data that we hold in our records, please be aware that no method of transmitting data over the internet or storing data is completely secure.
The Website may include social media features, such as the Facebook "Like" or "Share" buttons. These features may collect your IP address and which pages or features you are using or visiting on the website or the Website, and may set a cookie to enable the feature to function properly. Social Media features are either hosted by a third-party or hosted by us. Your interactions with these features are governed by the privacy policy of the company providing them. We do not control and we take no responsibility for the use of your Personal Data by these third-party sites.
The Website may contain links to other websites or apps. Your access to and use of such linked sites is not governed by this Privacy Policy but, instead, is governed by the privacy policies of those third-party websites. We are not responsible for the Personal Data practices of such third-party websites. Please review the privacy policies of such sites before you disclose your Personal Data to them.
The Children’s Online Privacy Protection Act (“COPPA”) requires that online service providers obtain parental consent before they knowingly collect personally identifiable information online from minors who are under 13 years of age. The Backpack Website is not intended for minors. We do not knowingly collect or solicit Personal Data from anyone under the age of 13. If we become aware that a child under the age 13 has provide Data to us, we will delete that Personal Data as quickly as possible. We may change this Privacy Policy from time to time to reflect changes in our practices concerning the collection, use, and sharing of Personal Data. The revised Privacy Policy will be effective immediately upon posting to our websites, by notification through the Website or through email. If you continue to use the Website after we make changes then you will be deemed to have agreed to the changes, so please check this Privacy Policy periodically for updates.
